RE: FN-FORUM domain name issue

If you have a trademark then you have a good chance to complain about
infringement, that and the fact that you have been trading under that name
for a period of years. However, it comes down to who has the biggest and
deepest pockets at the end of the day.
You could check the ICANN dispute policy as your starting point. However,
your "competitors" are in the US which is going to put you to a little
disadvantage right away.

Subject: FN-FORUM domain name issue
(Sorry if this is the second posting, I sent the last one using the wrong
address)
I was wondering if any of you have would ever dealt with an issue like this
before?....
I run a dating site called datemate.co.uk and have done since early 1999. At
the time I registered this domain the .com version was already taken but not
being used as a dating site. Over the past few years I have tried to acquire
the .com but unfortunately the asking price was a bit high for my liking
($10,000). In March 2001 the domain name was being offered for sale through
greatdomains, so I placed an offer, but unfortunatelty I was unsuccessful.
Last night a friend was looking for my site and came across datemate.com, it
is now being used as dating site and will undoubtedly have an effect on my
sites performance.
Do you reckon I have any exclusive right to use the name "DateMate" for a
dating service? based on the fact I was using it first.
Any thoughts?
