Yes, I'm aware. However, the point was a legal one. A person who
deliberately opens a locked box of code has done so with intent. A person
then using it has done so with intent. Case closed! No defence. It's better
than a contract. Open coding, on the other hand, can be open to the defence
(excuse) of "I saw it and assumed everyone does it that way so I did too!".
In other words, error but no intent, an important difference in law.
