Pretty much the same objections I had - payment terms, IPR, portfolio (more
on principle than because I would need it), I also objected to the shared
risk of non-payment though that was less significant.
I emailed the guy back saying I would like to do business but they would
have to adjust those terms. he responded that he wouldn't change his terms
as he had no problem getting people to sign up to those.
I suggested that was not the point and that a) terms should be win-win if
you want a sound long term relationship b) anyone who signed these was
probably not too savvy and hence he was self-selecting a poor partner pool.
However I think it was a brick wall, I just wanted to get validation from
the list that I am not on my own here.
Lee, it is up to you ofc but my take on it is that regardless of whether I
think I can afford to risk signing those terms, any "partner" who seeks to
make me sign up to such inequitable terms will happily shaft me in every
other part of the ongoing relationship also. I won't be signing.
